Second Chance Act - Pending President's Approval

Purpose: The U.S. Senate passed today the Second Chance Act of 2007. This landmark bill, introduced by Senators Joseph Biden (D-DE), Sam Brownback (R-KS), Patrick Leahy (D-VT), and Arlen Specter (R-PA), provides critical resources designed to reduce recidivism and increase public safety. The 1984 Bail Reform Act permitted courts to consider danger to the community in setting bail conditions, permitted courts to deny bail altogether where a defendant poses a grave danger to others, tightened the criteria for post-conviction release pending sentencing and appeal, and provided for release revocation and increased penalties for crimes committed while on release for bail jumping.
